The owner of a building in the Montreal borough of Lachine is attempting to eject its longtime tenants so that the building can be demolished and replaced with townhouses. The tenants, who own a dépanneur on the ground floor, have a registered commercial lease until at least 2025.
Me Goldwater, who is not involved with the case, commented that while commercial landlords are frequently within their rights to repossess their building, “often there are clauses that say he has to give you equivalent space somewhere else, for instance.”
