The owner of a building in the Montreal borough of Lachine is attempting to eject its longtime tenants so that the building can be demolished and replaced with townhouses. The tenants, who own a dépanneur on the ground floor, have a registered commercial lease until at least 2025.
Me Goldwater, who is not involved with the case, commented that while commercial landlords are frequently within their rights to repossess their building, « often there are clauses that say he has to give you equivalent space somewhere else, for instance. »
